Commercial Kitchen Regulations UK: Practical Guide

There is no single document called “the UK commercial kitchen regulations”. A compliant project brings together food hygiene law, workplace ventilation, gas safety, building regulations, fire safety, planning, environmental nuisance controls, utilities and manufacturer instructions. Which parts apply depends on the nation, premises, equipment, fuel and work being carried out.

Food hygiene and layout

The layout must allow food to be handled hygienically and help control contamination. Important considerations include:

  • adequate working space;
  • cleanable and maintainable surfaces;
  • suitable hand-washing arrangements;
  • hygienic equipment and utensil washing;
  • temperature-controlled storage;
  • waste routes and storage;
  • avoiding contaminated airflow into clean areas;
  • drainage that does not create a contamination risk;
  • access for cleaning around and behind equipment.

The exact design depends on what the business produces. Registering a food business, achieving planning permission and receiving a satisfactory food-hygiene inspection are related but different matters.

The Food Standards Agency's business guidance and the relevant local authority should be used during planning, not only immediately before opening.

Workplace ventilation

Regulation 6 of the Workplace (Health, Safety and Welfare) Regulations 1992 requires effective and suitable provision so enclosed workplaces are ventilated by a sufficient quantity of fresh or purified air.

Commercial cooking can create heat, steam, grease aerosols, smoke, odour and combustion products. The HSE's CAIS10 kitchen-ventilation guidance explains the need to remove cooking fumes at source, introduce replacement air and discharge extracted air safely.

This legal duty is broader than simply owning an extractor fan. The complete system has to work with the equipment, room and building.

DW/172 and kitchen ventilation design

BESA's DW/172 is the recognised industry specification for commercial kitchen ventilation systems. It covers matters including appliance-based airflow assessment, canopy and ventilated-ceiling design, grease separation, supply air, ductwork, controls, solid-fuel cooking, recirculation and commissioning.

DW/172 is not itself legislation. It is nevertheless an important reference for designers, contractors, clients and others who need a defined level of design and workmanship. The current second edition was published in 2018 and incorporates a May 2024 addendum.

Gas safety, BS 6173 and IGEM/UP/19

Employers and self-employed people have duties to keep gas appliances, installation pipework and flues maintained in a safe condition under the Gas Safety (Installation and Use) Regulations 1998.

BS 6173:2020 is the current British Standard for installation and maintenance of gas-fired catering appliances using natural gas or LPG. IGEM/UP/19 Edition 2 addresses the design and application of air-flow and air-quality interlocks and associated systems.

Gas work must be undertaken by a Gas Safe registered engineer qualified for the relevant commercial catering work. Check the engineer's current categories rather than relying on the words “Gas Safe”.

Fire safety and extract ductwork

Grease-laden extract systems can carry fire and smoke through a building. Design therefore has to consider:

  • duct route and construction;
  • fire compartments and penetrations;
  • access for inspection and cleaning;
  • grease accumulation;
  • fire-resisting enclosures or systems where required;
  • interaction with the building's fire strategy;
  • safe shutdowns and controls;
  • any fire-suppression provision.

Building Regulations and fire-safety duties apply to the project and premises. BESA's TR19® Grease focuses on fire-risk management through inspection, cleaning and evidence. It should not be confused with the design role of DW/172 or the sheet-metal ductwork role of DW/144.

Appoint a competent fire professional where the route, compartmentation or use makes the project complex.

Planning, odour and noise

External ductwork, fans, roof plant and changes of use may require planning permission. Local authorities may request details covering:

  • menu and cooking methods;
  • hours of use;
  • canopy and extract design;
  • fan duty and noise data;
  • duct route and discharge height;
  • grease, smoke and odour control;
  • maintenance arrangements;
  • nearby windows and other sensitive receptors.

EMAQ+ publishes specialist guidance on control of odour and noise from commercial kitchen exhaust systems. Councils may use it when considering risk and mitigation, but it is not itself legislation.

Smells from restaurants can be investigated as a statutory nuisance. GOV.UK explains that councils must investigate issues that could qualify and can serve an abatement notice where the legal test is met: statutory nuisances and council action.

Building regulations are separate from planning

Depending on the work and UK nation, relevant areas may include:

  • fire safety;
  • ventilation;
  • sanitation and hot water;
  • drainage and waste disposal;
  • combustion appliances and fuel storage;
  • electrical safety;
  • conservation of fuel and power;
  • access to and use of buildings.

In England, the government's Approved Documents collection provides guidance on ways of meeting Building Regulations. Other UK nations have their own systems and guidance. Always check jurisdiction and transitional provisions for the actual project date.

Manufacturer instructions remain essential

The equipment schedule should include the exact manufacturer and model as early as possible. Installation instructions can affect:

  • ventilation and flue arrangements;
  • clearances;
  • fuel and electrical load;
  • water quality;
  • drainage and condensate;
  • floor loading and restraint;
  • commissioning and warranty.

A general standard or blog cannot safely fill gaps left by an unknown appliance.

A sensible compliance sequence

  1. Define menu, capacity, hours, fuels and equipment.
  2. Survey the premises and service capacities.
  3. Check lease, lawful use, planning history and neighbour constraints.
  4. Appoint competent designers and engineers for ventilation, gas, electrical, fire and structural matters as required.
  5. Coordinate the designs rather than allowing trades to solve their elements separately on site.
  6. Obtain the necessary approvals before irreversible work.
  7. Install to the approved design and manufacturer instructions.
  8. Commission, demonstrate and record the completed systems.
  9. Keep cleaning, maintenance, test and training records after opening.
